ELEKTROBUDOWA SA informs

The Management Board of ELEKTROBUDOWA SA (hereinafter referred to as Contractor) inform that on 15 July 2014 a subsequent contract was signed with EDF Polska S.A. having its registered office in Warsaw, acting in its own name and as a plenipotentiary of Zespół Elektrociepłowni Wrocławskich KOGENERACJA S.A. with its registered office in Wrocław SA (hereinafter referred to as Purchasers).The aggregate value of contracts concluded with EDF Polska S.A. within the past 12 months to date is 33.161.234,11 PLN net, which meets the significance criterion with respect to the equity of ELEKTROBUDOWA SA.The contract signed on 11 March 2014 for the price of 15.466.000,00 PLN net (say: fifteen million four hundred and sixty six thousand Polish zloty only) was the agreement of the highest value. The subject matter of the agreement is modernization of substations for the EDF Group, of which for:EDF Polska SA Oddział Wybrzeże w Gdańsku - Elektrociepłownia Gdańska EC 2 within the project: modernization of three 6kV substations;Zespół Elektrociepłowni Wrocławskich KOGENERACJA SA - Elektrociepłownia Wrocław within the project: modernization of 6kV and 0,4 kV substation.Completion of the above works has been scheduled for 15 May 2015.Total amount of contractual penalties for all titles that the Purchaser may charge the Contractor shall not exceed 35% of the net contract price.Each of the Parties is entitled to seek supplemental compensation, exceeding the amount of stipulated contractual penalties, on general terms of the Polish Civil Code. The Purchaser is entitled to aggregate the penalties charged in respect of all titles.The aggregate liability of the Contractor for payment of compensation to the Purchaser resulting from any Purchaser's claims shall not exceed 100% of the total net contract price.Other conditions of the contract do not differ from terms generally applied to this type of contracts.Pursuant to Art. 5 item 1.3 of the Regulation of the Minister of Finance dated 19 February 2009 on current and interim information.
